Trueand absolute Proprietaries and Governors in Chief of the Province ofPennsylvania, and Counties of New Castle, Kent and Sussex, upon Delaware, Toall unto whom these Presents shall come, GREETING. WHEREAS in Consequence ofthe Application of Martin Hess No. 1660dated the Twenty fifth day of June 1766 for [unspecified] Acres of Land inHanover Township in the County of Lancaster a Survey hath been made of theTract of Land herein after mentioned and intended to be hereby granted andWhereas in pursuance of a Warrant dated the Twenty first day of November lastrequiring our Surveyor General to Accept the said Survey into his Office andmake Return thereof into our Secretary's Office in Order for Confirmation tothe said Martin Hess on the Terms inthe same Warrant mentioned he hath accordingly made Return thereof thereby tobe as follows, viz called Hess's HomeBeginning at a marked Dogwood Tree thence by Widow Clicks Land West Eighty seven perches and a quarter to apost South Eighteen perches and a half to a post North Eighty four Degrees Westfifty three perches to a post South Eighty Eight degrees West Thirty sixperches to a post North Eighty degrees West Eighty three perches to a postthence by John Bruners Land Norththirty five degrees East ninety seven perches to a post North Seven degreesEast seven perches to a marked white Oak North Seventy degrees East sixty twoperches to a marked white Oak thence by Isaac Meyers Land North Eighty Eight degrees East One hundredand Seventy Six perches to a marked black Oak thence by Peter Kettles Land South Eighteen degrees West One hundred andTwenty six perches to the place of Beginning Containing One Hundred and SeventyEight Acres and allowance of Six Cent? for Roads fee? As by the saidApplication Warrant and Survey remaining in the Surveyor Generals Office morefully appears.

 

NOW, atthe Instance and Request of the said Martin Hess that we would be pleased to grant him a Confirmation of the same, KNOWYE, That in Consideration of the Sum of Eight pounds Eighteen shillingsSterling money of Great Britain in lawful Money of Pennsylvania, to our Use paidby the said Martin Hess (the Receiptwhereof we hereby acknowledge, and thereof do acquit, and for ever dischargethe said Martin Hess his Heirs andAssigns, by these Presents) and of the yearly Quit rent herein after mentionedand reserved, WE HAVE given, granted, released and confirmed, and by thesePresents, for us, our Heirs and Successors, Do give, grant, release andconfirm, unto the said Martin Hess hisHeirs and Assigns, the said One hundred and Seventy Eight Acres of Land, as thesame are now set forth, bounded and limited as aforesaid; with all Mines,Minerals, Quarries, Meadows, Marshes, Savannahs, Swamps, Cripples, Woods,Underwoods, Timber and Trees, Ways, Waters, Water-Courses, Liberties, Profits,Commodities, Advantages, Hereditaments and Appurtenances whatsoever thereuntobelonging, or in any wise appertaining, and lying withing the Bounds and Limitsaforesaid, [Three full and clear Fifth Parts of all Royal Mines, free from allDeductions and Reprisals for digging and refining the same; and also One FifthPart of the Ore of all other Mines, delivered at the Pit's Mouth, onlyexcepted, and hereby reserved] and also free Leave, Right and Liberty, to andfor the said Martin Hess his Heirs andAssigns, to hawk, hunt, fish and fowl, in and upon the hereby granted Land andPremises, or upon any Part thereof. TO HAVE AND TO HOLD the said Described Tract of Land and Premises herebygranted (except as before excepted) with their Appurtenances, unto the said MartinHess his Heirs and Assigns, to the only Useand Behoof of the said Martin Hess hisHeirs and Assigns, for ever;  TO BEHOLDEN of us, our Heirs and Successors, Proprietaries of Pennsylvania, as ofour Manor of Conestoga in the County of Lancaster aforesaid, in free and commonSoccage by Fealty only, in Lieu of all other Services : YIELDING AND PAYINGtherefor yearly unto us, our Heirs and Successors, at the Town of Lancaster inthe said County at or upon the First Day of March, in every Year, from theFirst Day of March last? One Penny Sterling for every Acre of the same, orValue thereof in Coin current, according as the Exchange shall then be betweenour said Province and the City of London, to such Person or Persons as shall,from time to time, be appointed to receive the same.  AND in case of Non-payment thereof, within Ninety Days nextafter the same shall become due, that then it shall and may be lawful for us,our Heirs and Successors, our and their Receiver or Receivers, into and uponthe hereby granted Land and Premises to re-enter, and the same to hold andpossess, until the said Quit rent, and all Arrears thereof, together with theCharges accruing by means of such Non-payment and Re-entry, be fully paid anddischarged.  WITNESS JohnPenn Esqr. Lieutenant Governor of the saidProvince who by Virtue of certian Powers and Authorities to him for thisPurpose, inter alia, granted by the said Proprietaries, hath hereunto set hisHand, and caused the Great Seal of the said Province to be hereunto affixed, atPhiladelphia, this Fourth Day of December in the Year of Our Lord One ThousandSeven Hundred and sixty seven the eighth year of the Reign of King George theThird over Great-Britain, &c. and the Fiftieth Year of the saidProprietaries Government.
